1-1                                   AN ACT

 1-2     relating to removal of certain persons from the pool of prospective

 1-3     jurors.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter A, Chapter 62, Government Code, is

 1-6     amended by adding Section 62.0145 to read as follows:

 1-7           Sec. 62.0145.  REMOVAL OF CERTAIN PERSONS FROM POOL OF

 1-8     PROSPECTIVE JURORS.  If a written summons for jury service sent by

 1-9     a sheriff, constable, or bailiff is undeliverable, the county or

1-10     district clerk may remove from the jury wheel the jury wheel card

1-11     for the person summoned or remove the person's name from the record

1-12     of names for selection of persons for jury service under Section

1-13     62.011.

1-14           SECTION 2.  This Act takes effect September 1, 1997.

1-15           SECTION 3.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended.
