                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the priority given to certain victim compensation funds

 1-3     by the Texas Youth Commission when apportioning wages earned by

 1-4     certain children.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 61.123, Human Resources Code, is amended

 1-7     to read as follows:

 1-8           Sec. 61.123.  PAY AND DISTRIBUTION OF PAY.  The commission

 1-9     shall apportion wages earned by a child working under the

1-10     industries program in amounts determined at the discretion of the

1-11     commission, in the following priority:

1-12                 (1)  a person to whom the child has been ordered by a

1-13     court or to whom the child has agreed to pay restitution;

1-14                 (2)  a person to whom the child has been ordered by a

1-15     court to pay child support; [and]

1-16                 (3)  the compensation to victims of crime fund or the

1-17     compensation to victims of crime auxiliary fund; and

1-18                 (4)  the child's student account.

1-19           SECTION 2.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended,

1-24     and that this Act take effect and be in force from and after its

 2-1     passage, and it is so enacted.
