1-1 AN ACT
1-2 relating to a requirement that a municipality maintain a public
1-3 record of its extraterritorial jurisdiction.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 41.001, Local Government Code, is amended
1-6 to read as follows:
1-7 Sec. 41.001. MAP OF MUNICIPAL BOUNDARIES AND
1-8 EXTRATERRITORIAL JURISDICTION. (a) Each municipality shall
1-9 prepare a map that shows the boundaries of the municipality and of
1-10 its extraterritorial jurisdiction. A copy of the map shall be kept
1-11 in the office of the secretary or clerk of the municipality. If
1-12 the municipality has a municipal engineer, a copy of the map shall
1-13 also be kept in the office of the engineer.
1-14 (b) If the municipality annexes territory, the map shall be
1-15 immediately corrected to include the annexed territory. The map
1-16 shall be annotated to indicate:
1-17 (1) the date of annexation;
1-18 (2) the number of the annexation ordinance, if any;
1-19 and
1-20 (3) a reference to the minutes or municipal ordinance
1-21 records in which the ordinance is recorded in full.
1-22 (c) If the municipality's extraterritorial jurisdiction is
1-23 expanded or reduced, the map shall be immediately corrected to
1-24 indicate the change in the municipality's extraterritorial
2-1 jurisdiction. The map shall be annotated to indicate:
2-2 (1) the date the municipality's extraterritorial
2-3 jurisdiction was changed;
2-4 (2) the number of the ordinance or resolution, if any,
2-5 by which the change was made; and
2-6 (3) a reference to the minutes or municipal ordinance
2-7 or resolution records in which the ordinance or resolution is
2-8 recorded in full.
2-9 SECTION 2. This Act takes effect September 1, 1997.
2-10 SECTION 3. The importance of this legislation and the
2-11 crowded condition of the calendars in both houses create an
2-12 emergency and an imperative public necessity that the
2-13 constitutional rule requiring bills to be read on three several
2-14 days in each house be suspended, and this rule is hereby suspended.
