No. 2203 1-2 (In the Senate - Received from the House May 5, 1997; 1-3 May 6, 1997, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 13, 1997, reported favorably by 1-5 the following vote: Yeas 9, Nays 0; May 13, 1997, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to a requirement that a municipality maintain a public 1-10 record of its extraterritorial jurisdiction. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Section 41.001, Local Government Code, is amended 1-13 to read as follows: 1-14 Sec. 41.001. MAP OF MUNICIPAL BOUNDARIES AND 1-15 EXTRATERRITORIAL JURISDICTION. (a) Each municipality shall 1-16 prepare a map that shows the boundaries of the municipality and of 1-17 its extraterritorial jurisdiction. A copy of the map shall be kept 1-18 in the office of the secretary or clerk of the municipality. If 1-19 the municipality has a municipal engineer, a copy of the map shall 1-20 also be kept in the office of the engineer. 1-21 (b) If the municipality annexes territory, the map shall be 1-22 immediately corrected to include the annexed territory. The map 1-23 shall be annotated to indicate: 1-24 (1) the date of annexation; 1-25 (2) the number of the annexation ordinance, if any; 1-26 and 1-27 (3) a reference to the minutes or municipal ordinance 1-28 records in which the ordinance is recorded in full. 1-29 (c) If the municipality's extraterritorial jurisdiction is 1-30 expanded or reduced, the map shall be immediately corrected to 1-31 indicate the change in the municipality's extraterritorial 1-32 jurisdiction. The map shall be annotated to indicate: 1-33 (1) the date the municipality's extraterritorial 1-34 jurisdiction was changed; 1-35 (2) the number of the ordinance or resolution, if any, 1-36 by which the change was made; and 1-37 (3) a reference to the minutes or municipal ordinance 1-38 or resolution records in which the ordinance or resolution is 1-39 recorded in full. 1-40 SECTION 2. This Act takes effect September 1, 1997. 1-41 SECTION 3. The importance of this legislation and the 1-42 crowded condition of the calendars in both houses create an 1-43 emergency and an imperative public necessity that the 1-44 constitutional rule requiring bills to be read on three several 1-45 days in each house be suspended, and this rule is hereby suspended. 1-46 * * * * *
