1-1                                   AN ACT

 1-2     relating to municipal and county policies regarding enforcement of

 1-3     certain drug laws.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Chapter 370, Local Government Code, is amended by

 1-6     adding Section 370.003 to read as follows:

 1-7           Sec. 370.003.  MUNICIPAL OR COUNTY POLICY REGARDING

 1-8     ENFORCEMENT OF DRUG LAWS.  The governing body of a municipality,

 1-9     the commissioners court of a county, or a sheriff, municipal police

1-10     department, municipal attorney, county attorney, district attorney,

1-11     or criminal district attorney may not adopt a policy under which

1-12     the entity will not fully enforce laws relating to drugs, including

1-13     Chapters 481 and 483, Health and Safety Code, and federal law.

1-14           SECTION 2.  The importance of this legislation and the

1-15     crowded condition of the calendars in both houses create an

1-16     emergency and an imperative public necessity that the

1-17     constitutional rule requiring bills to be read on three several

1-18     days in each house be suspended, and this rule is hereby suspended,

1-19     and that this Act take effect and be in force from and after its

1-20     passage, and it is so enacted.
