1-1 AN ACT 1-2 relating to the authority of a general-law municipality to annex 1-3 additional areas. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter B, Chapter 43, Local Government Code, 1-6 is amended by adding Section 43.034 to read as follows: 1-7 Sec. 43.034. AUTHORITY OF GENERAL-LAW MUNICIPALITY TO ANNEX 1-8 AREA; CERTAIN MUNICIPALITIES. A general-law municipality may annex 1-9 adjacent territory without the consent of any of the residents or 1-10 voters of the area and without the consent of any of the owners of 1-11 land in the area if: 1-12 (1) the municipality has a population of 700-1,000, 1-13 part of whose boundary is part of the shoreline of a lake whose 1-14 normal surface area is 75,000 acres or greater and which is located 1-15 completely within the State of Texas; 1-16 (2) the procedural rules prescribed by this chapter 1-17 are met; 1-18 (3) the service plan requires that police and fire 1-19 protection at a level consistent with protection provided within 1-20 the municipality must be provided to the area within 10 days after 1-21 the effective date of the annexation; and 1-22 (4) the municipality and the affected landowners have 1-23 not entered an agreement to not annex the area for a certain 1-24 period. 2-1 SECTION 2. The importance of this legislation and the 2-2 crowded condition of the calendars in both houses create an 2-3 emergency and an imperative public necessity that the 2-4 constitutional rule requiring bills to be read on three several 2-5 days in each house be suspended, and this rule is hereby suspended, 2-6 and that this Act take effect and be in force from and after its 2-7 passage, and it is so enacted. _______________________________ _______________________________ President of the Senate Speaker of the House I certify that H.B.
