                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to vehicles for which an operator is required to have a

 1-3     commercial driver's license.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 522.004(a), Transportation Code, is

 1-6     amended to read as follows:

 1-7           (a)  This chapter does not apply to:

 1-8                 (1)  a vehicle that is controlled and operated by a

 1-9     farmer and:

1-10                       (A)  used to transport agricultural products,

1-11     farm machinery, or farm supplies to or from a farm;

1-12                       (B)  used within 150 miles of the person's farm;

1-13     and

1-14                       (C)  not used in the operations of a common or

1-15     contract motor carrier;

1-16                 (2)  a fire-fighting or emergency vehicle necessary to

1-17     the preservation of life or property or the execution of emergency

1-18     governmental functions, whether operated by an employee of a

1-19     political subdivision or by a volunteer fire fighter;

1-20                 (3)  a military vehicle, when operated for military

1-21     purposes by military personnel, including:

1-22                       (A)  active duty military personnel;  and

1-23                       (B)  members of the reserves and national guard

1-24     on active duty, including personnel on full-time national guard

 2-1     duty, personnel engaged in part-time training, and national guard

 2-2     military technicians;

 2-3                 (4)  a recreational vehicle that is driven for personal

 2-4     use; [or]

 2-5                 (5)  a vehicle that is owned, leased, or controlled by

 2-6     an air carrier, as defined by Section 21.155, and that is driven or

 2-7     operated exclusively by an employee of the air carrier only on the

 2-8     premises of an airport, as defined by Section 22.001, on service

 2-9     roads to which the public does not have access; or

2-10                 (6)  a vehicle used exclusively to transport seed

2-11     cotton modules or cotton burrs.

2-12           SECTION 2.  The importance of this legislation and the

2-13     crowded condition of the calendars in both houses create an

2-14     emergency and an imperative public necessity that the

2-15     constitutional rule requiring bills to be read on three several

2-16     days in each house be suspended, and this rule is hereby suspended,

2-17     and that this Act take effect and be in force from and after its

2-18     passage, and it is so enacted.
