                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to limiting the liability of the State Commission on

 1-3     Judicial Conduct.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter B, Chapter 33, Government Code, is

 1-6     amended by adding Section 33.035 to read as follows:

 1-7           Sec. 33.035.  IMMUNITY.  The commission, any member of the

 1-8     commission, the executive director of the commission, any employee

 1-9     of the commission, or any special master or special counsel

1-10     assisting the commission is not liable for any damages for an act

1-11     or omission in the course of the official duties of the commission.

1-12           SECTION 2.  The importance of this legislation and the

1-13     crowded condition of the calendars in both houses create an

1-14     emergency and an imperative public necessity that the

1-15     constitutional rule requiring bills to be read on three several

1-16     days in each house be suspended, and this rule is hereby suspended,

1-17     and that this Act take effect and be in force from and after its

1-18     passage, and it is so enacted.

1-19                          COMMITTEE AMENDMENT NO. 1

1-20           Amend H.B. 2421 by striking lines 7-11 and replacing with:

1-21           Sec. 33.035.  IMMUNITY.  (a)  A public member of the

1-22     commission is not liable for any damages for an act or omission in

1-23     the course of the official duties of the commission.

1-24           (b)  Subsection (a) shall not limit the liability of a public

 2-1     member of the commission for any act or omission in bad faith or

 2-2     involving gross negligence, intentional misconduct, or a knowing

 2-3     violation of the law.
