                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to exempting certain students from the Texas Academic

 1-3     Skills Program testing.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 51.306, Education Code, is amended by

 1-6     adding Subsection (l) to read as follows:

 1-7           (l)  A student is exempt from this section if the student:

 1-8                 (1)  on four separate occasions has had a score on the

 1-9     test instrument that was below the minimum performance standards

1-10     established under Subsection (e);

1-11                 (2)  has completed any remediation course or program

1-12     required by any institution the student has attended;

1-13                 (3)  has completed all college courses with at least a

1-14     "C" average or its equivalent and has repeated any course in which

1-15     the student received a failing grade and has obtained at least a

1-16     "C" or its equivalent in each of those courses; and

1-17                 (4)  has completed 60 or more semester credit hours and

1-18     has obtained a grade point average of at least 2.75 on a scale of

1-19     4.0 or its equivalent.

1-20           SECTION 2.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended,

 2-1     and that this Act take effect and be in force from and after its

 2-2     passage, and it is so enacted.
