                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the eligibility of a person to be an employee of the

 1-3     Texas Lottery Commission, to purchase a lottery ticket, or to

 1-4     claim, collect, or receive a lottery prize.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 467.034, Government Code, is amended to

 1-7     read as follows:

 1-8           Sec. 467.034.  Employees.  The executive director shall

 1-9     employ other personnel necessary to administer the laws under the

1-10     commission's jurisdiction.  Commission employees serve at the will

1-11     of the executive director.  The executive director may not employ

1-12     any person who would be denied a license as a sales agent under

1-13     Section 466.155.

1-14           SECTION 2.  Section 466.254, Government Code, is amended to

1-15     read as follows:

1-16           Sec. 466.254.  Purchase of Ticket by or Payment of Prize to

1-17     Certain Persons.  A person may not purchase a ticket or claim,

1-18     collect, or receive a lottery prize or a share of a lottery prize

1-19     if the person is:

1-20                 (1)  a member, officer, or employee of a person that

1-21     has a contract with the commission to sell or lease goods or

1-22     services used in the operation of the lottery and the member,

1-23     officer, or employee is directly involved in selling or leasing the

1-24     goods or performing the services made the subject of the contract

 2-1     with the commission;

 2-2                 (2)  a member, officer, or employee of a lottery

 2-3     operator;

 2-4                 (3)  an officer or employee of the commission; or

 2-5                 (4)  a spouse, child, brother, sister, or parent

 2-6     residing as a member of the same household in the principal place

 2-7     of residence of a person described by Subdivision (1), (2), or (3).

 2-8           SECTION 3.  This Act takes effect September 1, 1997.

 2-9           SECTION 4.  The importance of this legislation and the

2-10     crowded condition of the calendars in both houses create an

2-11     emergency and an imperative public necessity that the

2-12     constitutional rule requiring bills to be read on three several

2-13     days in each house be suspended, and this rule is hereby suspended.
