1-1                                   AN ACT

 1-2     relating to the authority of the Texas State Library and Archives

 1-3     Commission to accept donations and services from certain sources.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 441.006(b), Government Code, is amended

 1-6     to read as follows:

 1-7           (b)  The commission may:

 1-8                 (1)  purchase, as state property, any suitable book,

 1-9     picture, or similar item, within the limits of the annual

1-10     legislative appropriation;

1-11                 (2)  receive a donation or gift of money, [or]

1-12     property, or services on any terms and conditions it considers

1-13     proper as long as the state does not incur financial liability;

1-14                 (3)  accept, receive, and administer federal funds made

1-15     available by grant or loan to improve the public libraries of this

1-16     state; [and]

1-17                 (4)  contract or agree with the governing body or head

1-18     of a county, city, or town of this state to meet the terms

1-19     prescribed by the United States and consistent with state law for

1-20     the expenditure of federal funds for improving public libraries;

1-21     and

1-22                 (5)  participate in the establishment and operation of

1-23     an affiliated nonprofit organization whose purpose is to raise

1-24     funds for or provide services or other benefits to the commission.

 2-1           SECTION 2.  This Act takes effect September 1, 1997.

 2-2           SECTION 3.  The importance of this legislation and the

 2-3     crowded condition of the calendars in both houses create an

 2-4     emergency and an imperative public necessity that the

 2-5     constitutional rule requiring bills to be read on three several

 2-6     days in each house be suspended, and this rule is hereby suspended.
