No. 2585 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to industrial solid waste management in municipal solid 1-3 waste landfills. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 361.019(a), Health and Safety Code, is 1-6 amended to read as follows: 1-7 (a) Except as provided by Subsection (b), Class I 1-8 nonhazardous industrial solid waste and small quantities of 1-9 hazardous waste generated by conditionally exempt small quantity 1-10 generators, as defined by the commission, and any other waste 1-11 material authorized by federal regulations for acceptance at a 1-12 municipal solid waste facility may be accepted in a municipal solid 1-13 waste facility if: 1-14 (1) the waste is: 1-15 (A) handled at the municipal solid waste 1-16 facility specifically authorized by permit to accept the waste, 1-17 notwithstanding a commission rule to the contrary adopted after the 1-18 permit was issued; or 1-19 (B) authorized in writing by, or by rule of, the 1-20 commission; and 1-21 (2) the generator of the Class I nonhazardous waste 1-22 certifies on an appropriate commission form that the waste is not a 1-23 hazardous waste. 1-24 SECTION 2. This Act takes effect September 1, 1997, and 2-1 applies to: 2-2 (1) a permit issued by the Texas Natural Resource 2-3 Conservation Commission that is in effect on or issued after 2-4 September 1, 1997; and 2-5 (2) a rule adopted by the Texas Natural Resource 2-6 Conservation Commission that is in effect on or adopted after 2-7 September 1, 1997. 2-8 SECTION 3. The importance of this legislation and the 2-9 crowded condition of the calendars in both houses create an 2-10 emergency and an imperative public necessity that the 2-11 constitutional rule requiring bills to be read on three several 2-12 days in each house be suspended, and this rule is hereby suspended.
