                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the disposition of certain money collected by a

 1-3     constable.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter F, Chapter 118, Local Government Code,

 1-6     is amended by adding Section 118.135 to read as follows:

 1-7           Sec. 118.135.  DISPOSITION OF CERTAIN FEES COLLECTED BY

 1-8     CONSTABLE.  (a)  Money collected by a constable who executes a

 1-9     service of notice in an eviction action, including a notice to quit

1-10     or notice to vacate, in the constable's official capacity shall be

1-11     deposited with the county treasurer as provided by Section 154.003

1-12     and Section 113.021.

1-13           (b)  A constable executes service of notice in the

1-14     constable's official capacity if the constable executes the service

1-15     in uniform during the constable's regular duty hours.

1-16           SECTION 2.  The importance of this legislation and the

1-17     crowded condition of the calendars in both houses create an

1-18     emergency and an imperative public necessity that the

1-19     constitutional rule requiring bills to be read on three several

1-20     days in each house be suspended, and this rule is hereby suspended.
