No. 2738 1-2 (In the Senate - Received from the House April 27, 1997; 1-3 April 29, 1997, read first time and referred to Committee on 1-4 Criminal Justice; May 18, 1997, reported favorably by the following 1-5 vote: Yeas 7, Nays 0; May 18, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to authorizing the Texas Board of Criminal Justice to 1-9 convey real property in exchange for property of equivalent fair 1-10 market value. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subchapter A, Chapter 496, Government Code, is 1-13 amended by adding Section 496.0032 to read as follows: 1-14 Sec. 496.0032. EXCHANGE OF REAL PROPERTY. (a) The board 1-15 may convey real property under the board's management and control 1-16 to a third party if the third party conveys real property of an 1-17 equivalent fair market value to the board. 1-18 (b) The General Land Office shall negotiate and close a 1-19 transaction under this section on behalf of the board. 1-20 SECTION 2. The importance of this legislation and the 1-21 crowded condition of the calendars in both houses create an 1-22 emergency and an imperative public necessity that the 1-23 constitutional rule requiring bills to be read on three several 1-24 days in each house be suspended, and this rule is hereby suspended, 1-25 and that this Act take effect and be in force from and after its 1-26 passage, and it is so enacted. 1-27 * * * * *
