                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to records of the Texas Lottery Commission that are open

 1-3     for public inspection.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 466.022, Government Code, is amended to

 1-6     read as follows:

 1-7           Sec. 466.022.  Confidential Information.  (a)  Except as

 1-8     otherwise provided by law, all commission records are subject to

 1-9     public inspection in accordance with Chapter 552.

1-10           (b)  In addition to commission records excepted from

1-11     disclosure under Chapter 552, the [The] following information is

1-12     confidential and is exempt from disclosure [under Chapter 552]:

1-13                 (1)  security plans and procedures of the commission

1-14     designed to ensure the integrity and security of the operation of

1-15     the lottery;

1-16                 (2)  information of a nature that is designed to ensure

1-17     the integrity and security of the selection of winning tickets or

1-18     numbers in the lottery, other than information describing the

1-19     general procedures for selecting winning tickets or numbers; and

1-20                 (3)  the street address and telephone number of a prize

1-21     winner, if the prize winner has not consented to the release of the

1-22     information.

1-23           SECTION 2.  Section 467.104(a), Government Code, is amended

1-24     to read as follows:

 2-1           (a)  Except as otherwise provided by law, all [All]

 2-2     commission records are subject to public inspection in accordance

 2-3     with Chapter 552 [that are not made confidential by other law are

 2-4     open to inspection by the public during regular office hours].

 2-5           SECTION 3.  Section 28, Bingo Enabling Act (Article 179d,

 2-6     Vernon's Texas Civil Statutes), is amended to read as follows:

 2-7           Sec. 28.  INFORMATION AVAILABLE FOR PUBLIC INSPECTION.

 2-8     Except as otherwise provided by law, all commission records are

 2-9     subject to public inspection in accordance with Chapter 552,

2-10     Government Code [All applications, returns, reports, statements,

2-11     and audits submitted to or conducted by the commission and the

2-12     governing body are available for public inspection].

2-13           SECTION 4.  This Act takes effect September 1, 1997.

2-14           SECTION 5.  The importance of this legislation and the

2-15     crowded condition of the calendars in both houses create an

2-16     emergency and an imperative public necessity that the

2-17     constitutional rule requiring bills to be read on three several

2-18     days in each house be suspended, and this rule is hereby suspended.
