1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to records of the Texas Lottery Commission that are open
1-9 for public inspection.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 466.022, Government Code, is amended to
1-12 read as follows:
1-13 Sec. 466.022. Confidential Information. (a) Except as
1-14 otherwise provided by law, all commission records are subject to
1-15 public inspection in accordance with Chapter 552.
1-16 (b) In addition to commission records excepted from
1-17 disclosure under Chapter 552, the [The] following information is
1-18 confidential and is exempt from disclosure [under Chapter 552]:
1-19 (1) security plans and procedures of the commission
1-20 designed to ensure the integrity and security of the operation of
1-21 the lottery;
1-22 (2) information of a nature that is designed to ensure
1-23 the integrity and security of the selection of winning tickets or
1-24 numbers in the lottery, other than information describing the
1-25 general procedures for selecting winning tickets or numbers; and
1-26 (3) the street address and telephone number of a prize
1-27 winner, if the prize winner has not consented to the release of the
1-28 information.
1-29 SECTION 2. Section 467.104(a), Government Code, is amended
1-30 to read as follows:
1-31 (a) Except as otherwise provided by law, all [All]
1-32 commission records are subject to public inspection in accordance
1-33 with Chapter 552 [that are not made confidential by other law are
1-34 open to inspection by the public during regular office hours].
1-35 SECTION 3. Section 28, Bingo Enabling Act (Article 179d,
1-36 Vernon's Texas Civil Statutes), is amended to read as follows:
1-37 Sec. 28. INFORMATION AVAILABLE FOR PUBLIC INSPECTION.
1-38 Except as otherwise provided by law, all commission records are
1-39 subject to public inspection in accordance with Chapter 552,
1-40 Government Code [All applications, returns, reports, statements,
1-41 and audits submitted to or conducted by the commission and the
1-42 governing body are available for public inspection].
1-43 SECTION 4. This Act takes effect September 1, 1997.
1-44 SECTION 5. The importance of this legislation and the
1-45 crowded condition of the calendars in both houses create an
1-46 emergency and an imperative public necessity that the
1-47 constitutional rule requiring bills to be read on three several
1-48 days in each house be suspended, and this rule is hereby suspended.
