                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to waiver of a motor vehicle insurance deductible on

 1-3     repair of a damaged automobile windshield.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter E, Chapter 21, Insurance Code, is

 1-6     amended by adding Article 21.79H to read as follows:

 1-7           Art. 21.79H. WAIVER OF MOTOR VEHICLE INSURANCE DEDUCTIBLES ON

 1-8     REPAIR OF A DAMAGED AUTOMOBILE WINDSHIELD.  A motor vehicle insurer

 1-9     may adopt a uniform and non-discriminatory practice of allowing the

1-10     waiver of an insured's deductible when the insured agrees in

1-11     writing to have damaged automobile windshield glass on the

1-12     insured's vehicle repaired rather than replaced.  The Commissioner

1-13     may adopt rules to implement this article.

1-14           SECTION 2.  This act takes effect September 1, 1997.

1-15           SECTION 3.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended,

1-20     and that this Act take effect and be in force from and after its

1-21     passage, and it is so enacted.
