                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the authority of certain municipalities to set speed

 1-3     limits.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 545.356, Transportation Code, is amended

 1-6     by adding Subsection (d) to read as follows:

 1-7           (d)  Notwithstanding Subsections (a) and (b), a municipality

 1-8     with a population of less than 1,000 that contains two or more

 1-9     highways that are designated as United States highways may by

1-10     ordinance alter the prima facie speed limit on any road or highway

1-11     in the state highway system located in the municipality without an

1-12     engineering and traffic investigation.  The prima facie speed limit

1-13     may not be set lower than 30 miles per hour or higher than 60 miles

1-14     per hour.

1-15           SECTION 2.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended,

1-20     and that this Act take effect and be in force from and after its

1-21     passage, and it is so enacted.
