                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to an appeal from the entry of a protective order.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Chapter 71, Family Code, is amended by adding

 1-5     Section 71.20 to read as follows:

 1-6           Sec. 71.20.  APPEAL.  The entry of a protective order by a

 1-7     court under this chapter is an interlocutory order that may be

 1-8     appealed as other interlocutory orders listed under Section 51.014,

 1-9     Civil Practice and Remedies Code.

1-10           SECTION 2.  This Act takes effect September 1, 1997, and

1-11     applies only to the entry of a protective order under Chapter 71,

1-12     Family Code, on or after that date.  The entry of a protective

1-13     order under Chapter 71, Family Code, before the effective date of

1-14     this Act is governed by the law applicable to the entry of the

1-15     order immediately before the effective date of this Act, and that

1-16     law is continued in effect for that purpose.

1-17           SECTION 3.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended.
