                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the work outside fences in automotive wrecking or

 1-3     salvage yards and the display or storage of junked items outside

 1-4     those fences in certain counties.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 397.001, Transportation Code, is amended

 1-7     to read as follows:

 1-8           Sec.  397.001. APPLICABILITY OF CHAPTER.  This chapter

 1-9     applies only to an automotive wrecking and salvage yard that:

1-10                 (1)  is in a county with a population of two million or

1-11     more;

1-12                 (2)  is not located within a municipality in that

1-13     county;  and

1-14                 (3)  is established on or after September 1, 1983,

1-15     except as provided by Section 397.007.

1-16           SECTION 2.  Section 397.007, Transportation Code, is amended

1-17     to read as follows:

1-18           Sec.  397.007. DISPLAY OR WORK OUTSIDE FENCE PROHIBITED.  (a)

1-19     An owner or operator of an automotive wrecking and salvage yard or

1-20     that person's agent or employee may not display, store, or work on

1-21     a junked or wrecked automotive vehicle or a part, accessory, or

1-22     junk from the vehicle outside or above the fence required by this

1-23     chapter.

1-24           (b)  This section applies regardless of when the automotive

 2-1     wrecking and salvage yard was established.

 2-2           SECTION 3.  This Act takes effect September 1, 1997.

 2-3           SECTION 4.  The importance of this legislation and the

 2-4     crowded condition of the calendars in both houses create an

 2-5     emergency and an imperative public necessity that the

 2-6     constitutional rule requiring bills to be read on three several

 2-7     days in each house be suspended, and this rule is hereby suspended.
