No. 2868 1-2 (In the Senate - Received from the House May 12, 1997; 1-3 May 13, 1997, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 16, 1997, reported favorably by 1-5 the following vote: Yeas 11, Nays 0; May 16, 1997, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to a master drainage plan for certain counties. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Chapter 411, Local Government Code, is amended by 1-12 adding Section 411.007 to read as follows: 1-13 Sec. 411.007. MASTER DRAINAGE PLAN FOR CERTAIN COUNTIES. 1-14 (a) This section applies only to a county that: 1-15 (1) has a population of 190,000 or more, is adjacent 1-16 to a county with a population of 2,400,000 or more, and borders the 1-17 Gulf of Mexico; and 1-18 (2) operates a road department system under Subchapter 1-19 D, Chapter 252, Transportation Code. 1-20 (b) The commissioners court may require the county road 1-21 engineer to prepare and coordinate a county master drainage plan. 1-22 The commissioners court by order may adopt regulations to implement 1-23 the county master drainage plan. 1-24 SECTION 2. This Act takes effect September 1, 1997. 1-25 SECTION 3. The importance of this legislation and the 1-26 crowded condition of the calendars in both houses create an 1-27 emergency and an imperative public necessity that the 1-28 constitutional rule requiring bills to be read on three several 1-29 days in each house be suspended, and this rule is hereby suspended. 1-30 * * * * *
