                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to regulation of membership on local governing bodies by

 1-3     employees of participating labor organizations.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Chapter 171 of the Local Government Code,

 1-6     regulating conflicts of interest of local public officials, is

 1-7     amended by adding Section 171.010, to read as follows:

 1-8           Sec. 171.010.  SERVICE ON BEHALF OF LABOR ORGANIZATION

 1-9     REPRESENTING GOVERNMENT EMPLOYEES.  No member of a governing body

1-10     of a local governmental entity, who is employed by or has a

1-11     substantial interest in a labor organization that represents

1-12     employees of the local governmental entity, may participate in any

1-13     deliberation or action, or be present during a closed meeting,

1-14     concerning wages, hours of employment or conditions of work of any

1-15     employees or classification of employees of the local governmental

1-16     entity that such labor organization represents.

1-17           SECTION 2.  The change in law made by this Act applies only

1-18     to persons elected to a governing body on or after the effective

1-19     date of this act.

1-20           SECTION 3.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended,

 2-1     and that this Act take effect and be in force from and after its

 2-2     passage, and it is so enacted.
