                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to contracts with commissioners court in counties with

 1-3     population of 1,200,000 or more.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 316.021, Local Government Code, is

 1-6     amended by adding Subsection (d) to read as follows:

 1-7           (d)  Should the commissioners court enter into a reciprocal

 1-8     contract with a responsible 501(c)(3) nonprofit organization to

 1-9     manage and operate a museum, building or site, admissions fees may

1-10     be charged, collected and used by such organization and not placed

1-11     in a county special fund, on the condition that at the time the

1-12     admission fees are charged and collected such organization shall

1-13     not be obligated in any way to the county in connection with

1-14     capital improvements to the museum, building or site.  Expenditures

1-15     of admission fees by such a nonprofit organization shall in this

1-16     circumstance be with the concurrence of the commissioners court and

1-17     the governing board of the contracted organization, according to

1-18     the parties' contract.

1-19           SECTION 2.  This Act takes effect September 1, 1997.

1-20           SECTION 3.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended.
