A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the governance and operation of Prairie View A&M
1-3 University.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 66.03, Education Code, is amended by
1-6 adding Subsection (d) to read as follows:
1-7 (d) The board of regents of The University of Texas System
1-8 and The Texas A&M University System annually shall enter into a
1-9 contract with the board of regents of Prairie View A&M University.
1-10 The contract shall require the university systems to contract with
1-11 Prairie View A&M University for the provision and payment of
1-12 services or goods having a value of at least one-third of the
1-13 money each university system receives under Subsection (b) or (c).
1-14 The university systems may enter into separate contracts.
1-15 SECTION 2. Section 86.02, Education Code, is amended to read
1-16 as follows:
1-17 Sec. 86.02. TEXAS A&M UNIVERSITY. Texas A&M University is
1-18 an institution of higher education located in the city of College
1-19 Station. It is under the management and control of the board of
1-20 regents of Prairie View A&M University for the purposes of Section
1-21 13, Article VII, Texas Constitution, and Section 87.102. For all
1-22 other purposes, it is under the management and control of the board
1-23 of regents [directors] of The Texas A&M University System.
1-24 SECTION 3. Section 87.102, Education Code, is amended to
2-1 read as follows:
2-2 Sec. 87.102. GOVERNING BOARD. (a) The university is under
2-3 the control and supervision of the board of regents of Prairie View
2-4 A&M [directors of The Texas A&M] University [System]. The board
2-5 has the same powers and duties with respect to this university that
2-6 [as] are conferred [on it] by statute with respect to the board of
2-7 regents of The Texas A&M University System. The board shall be
2-8 composed of nine members appointed by the governor.
2-9 (b) The board of regents of Prairie View A&M University
2-10 shall be considered the governing board of Texas A&M University for
2-11 the purposes of Section 13, Article VII, Texas Constitution. The
2-12 only action the board of regents of Prairie View A&M University
2-13 may take with regard to the governing of Texas A&M University under
2-14 Section 13, Article VII, Texas Constitution, is to annually accept
2-15 and review a report on the operation of the university.
2-16 SECTION 4. Sections 87.103(a) and (c), Education Code, are
2-17 amended to read as follows:
2-18 (a) The 110 acres, more or less, of land in Waller County
2-19 near Prairie View A&M University, but not adjoining its campus,
2-20 conveyed as a gift to the Governor of the State of Texas when the
2-21 site for then Prairie View Normal and Industrial College was
2-22 purchased, is placed under the control and supervision of the board
2-23 [Board] of regents of Prairie View A&M University [Directors of The
2-24 Texas A&M University System] for the use and benefit of Prairie
2-25 View A&M University.
2-26 (c) The board of regents [directors] is authorized to lease
2-27 the land for oil, gas, sulphur, and other mineral development under
3-1 existing law applicable to other lands under the [its] control and
3-2 supervision of an institution of higher education and to apply the
3-3 proceeds from such lease to the use and benefit of Prairie View A&M
3-4 University.
3-5 SECTION 5. (a) Except as provided by Subsection (b), this
3-6 Act takes effect January 1, 1998.
3-7 (b) The governor shall, not later than November 1, 1997,
3-8 appoint members to the board of regents of Prairie View A&M
3-9 University.
3-10 (c) Not later than December 1, 1997, the board of regents of
3-11 The Texas A&M University System and the board of regents of Prairie
3-12 View A&M University shall meet and confer on the orderly transfer
3-13 of control and management of Prairie View A&M University. Both
3-14 boards may transfer any property or records necessary for the
3-15 orderly and timely transfer of governance of the control of Prairie
3-16 View A&M University.
3-17 (d) Not later than January 1, 1998, the boards of regents of
3-18 The University of Texas System, The Texas A&M University System,
3-19 and Prairie View A&M University shall meet and reach an agreement
3-20 required under Section 66.003(d), Education Code, as added by this
3-21 Act.
3-22 SECTION 6. The importance of this legislation and the
3-23 crowded condition of the calendars in both houses create an
3-24 emergency and an imperative public necessity that the
3-25 constitutional rule requiring bills to be read on three several
3-26 days in each house be suspended, and this rule is hereby suspended.
