                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to an act to clarify the manner of precommitment approval

 1-3     for routine purchases by a port authority district that adopts the

 1-4     purchasing requirements of subchapter N of Chapter 60 of the Water

 1-5     Code.

 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-7           SECTION 1.  Section 60.403 of the Water Code is amended to

 1-8     read as follows:

 1-9           A port commission or authorized designated officer of the

1-10     port commission may make routine purchases or contracts in an

1-11     amount not to exceed $25,000.  Before a purchase is made, a

1-12     purchase order, or some other form of precommitment approval, must

1-13     be signed by the executive director of the district or the port

1-14     authority or the authorized designated officer.  A list of routine

1-15     purchases or contracts may be signed by the executive director as a

1-16     form of precommitment approval for the purchases on the list, and

1-17     such list shall remain on file in the district or port authority.

1-18     A [The] purchase order must be executed in duplicate with one copy

1-19     delivered to the person from whom the purchase is made and one copy

1-20     remaining on file in the district or port authority.

1-21           SECTION 2.  This Act takes effect September 1, 1997.

1-22           SECTION 3.  The importance of this legislation and the

1-23     crowded condition of the calendars in both houses create an

1-24     emergency and an imperative public necessity that the

 2-1     constitutional rule requiring bills to be read on three several

 2-2     days in each house be suspended, and this rule is hereby suspended.
