A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to salaries of certain school district employees.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. The heading of Section 21.402, Education Code, is
1-5 amended to read as follows:
1-6 Sec. 21.402. MINIMUM SALARY SCHEDULE FOR PROFESSIONAL
1-7 EMPLOYEES [CLASSROOM TEACHERS AND FULL-TIME LIBRARIANS].
1-8 SECTION 2. Section 21.402, Education Code, is amended by
1-9 amending Subsections (a), (e), and (f) and adding Subsection (g) to
1-10 read as follows:
1-11 (a) Except as provided by Subsection (d) or (e), a school
1-12 district must pay each professional employee [classroom teacher or
1-13 full-time librarian] not less than the minimum monthly salary,
1-14 based on the employee's level of experience, determined by the
1-15 following formula:
1-17 where:
1-18 "MS" is the minimum monthly salary;
1-19 "SF" is the applicable salary factor specified by Subsection
1-20 (c);
1-21 "FSP" is the amount appropriated in the General
1-22 Appropriations Act for the fiscal year for the Foundation School
1-23 Program, as determined by the commissioner as provided by
1-24 Subsection (b); and
2-1 "ADA" is the total estimated average daily attendance, as
2-2 defined by Section 42.005, used for purposes of the General
2-3 Appropriations Act for the fiscal year.
2-4 (e) Notwithstanding Subsection (a), a professional employee
2-5 [teacher or librarian] who received a career ladder supplement on
2-6 August 31, 1993, is entitled to at least the same gross monthly
2-7 salary the employee [teacher or librarian] received for the
2-8 1994-1995 school year as long as the employee [teacher or
2-9 librarian] is employed by the same district.
2-10 (f) In this section, "gross monthly salary" must include the
2-11 amount a professional employee [teacher or librarian] received that
2-12 represented a career ladder salary supplement under Section 16.057,
2-13 as that section existed January 1, 1993.
2-14 (g) In this section, "professional employee" means a
2-15 full-time employee who is employed as a nurse or who is required to
2-16 hold a certificate issued under Subchapter B, other than a teacher
2-17 intern, teacher trainee, or educational aide.
2-18 SECTION 3. Sections 21.403(a), (c), and (d), Education Code,
2-19 are amended to read as follows:
2-20 (a) A professional employee [teacher or librarian] shall
2-21 advance one step on the minimum salary schedule under Section
2-22 21.402 for each year of experience as a professional employee
2-23 [teacher or librarian] until step 20 is reached.
2-24 (c) In determining the placement of a professional employee
2-25 [teacher or librarian] on the minimum salary schedule, a district
2-26 shall credit the person for each year of experience without regard
2-27 to whether the years are consecutive.
3-1 (d) As long as a professional employee [teacher or
3-2 librarian] who received a career ladder supplement is employed by
3-3 the same school district, the employee [teacher or librarian] is
3-4 entitled to:
3-5 (1) placement on the minimum salary schedule at the
3-6 step above the step on which the employee [teacher] would otherwise
3-7 be placed, if the employee [teacher or librarian] received a career
3-8 ladder supplement for level two of the career ladder on August 31,
3-9 1993; or
3-10 (2) placement on the minimum salary schedule at the
3-11 step two steps above the step on which the employee [teacher] would
3-12 otherwise be placed, if the employee [teacher or librarian]
3-13 received a career ladder supplement for level three of the career
3-14 ladder on August 31, 1993.
3-15 SECTION 4. Section 30.102(b), Education Code, is amended to
3-16 read as follows:
3-17 (b) A professional employee [classroom teacher or full-time
3-18 librarian] employed by the commission is entitled to receive as a
3-19 minimum salary the monthly salary rate specified by Section 21.402.
3-20 A professional employee [classroom teacher or full-time librarian]
3-21 may be paid, from funds appropriated to the commission, a salary in
3-22 excess of the minimum specified by that section, but the salary may
3-23 not exceed the rate of pay for a similar position in the public
3-24 schools of an adjacent school district. In this subsection,
3-25 "professional employee" has the meaning assigned by Section
3-26 21.402(g).
3-27 SECTION 5. This Act applies beginning with the 1997-1998
4-1 school year.
4-2 SECTION 6. The importance of this legislation and the
4-3 crowded condition of the calendars in both houses create an
4-4 emergency and an imperative public necessity that the
4-5 constitutional rule requiring bills to be read on three several
4-6 days in each house be suspended, and this rule is hereby suspended,
4-7 and that this Act take effect and be in force from and after its
4-8 passage, and it is so enacted.
