No. 3021 75R9218 PAM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the method of providing notice to vacate the premises 1-3 in connection with an eviction action. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 24.005(f), Property Code, is amended to 1-6 read as follows: 1-7 (f) The notice to vacate shall be given in person or by mail 1-8 at the premises in question. Notice in person may be by personal 1-9 delivery to the tenant or any person residing at the premises who 1-10 is 16 years of age or older or personal delivery to the premises 1-11 and affixing the notice to the inside of the main entry door. If a 1-12 keyless bolting device, alarm system, or other impediment prevents 1-13 the landlord from entering the premises, the landlord may affix the 1-14 notice to the outside of the main entry door. Notice by mail may 1-15 be by regular mail or by registered or certified mail, return 1-16 receipt requested, to the premises in question. 1-17 SECTION 2. The importance of this legislation and the 1-18 crowded condition of the calendars in both houses create an 1-19 emergency and an imperative public necessity that the 1-20 constitutional rule requiring bills to be read on three several 1-21 days in each house be suspended, and this rule is hereby suspended, 1-22 and that this Act take effect and be in force from and after its 1-23 passage, and it is so enacted. 1-24 COMMITTEE AMENDMENT NO. 1 2-1 Amend HB 3021 on page 1 of the bill at line 12, strike the 2-2 words "other impediment" and insert the words "dangerous animal" 2-3 and on page 1 at line 13, between the words "may" and "affix", 2-4 insert the word "securely"; and on page 1 of the bill at line 15, 2-5 insert the word "by" between the words "or" and "certified." 2-6 Solomons
