                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the enforcement of a municipality's ordinances

 1-3     regulating buildings or other structures.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter A, Chapter 214, Local Government Code,

 1-6     is amended by adding Section 214.005 to read as follows:

 1-7           Sec. 214.005. ENFORCEMENT.  (a)  A municipality may designate

 1-8     a municipal employee or department to enforce an ordinance adopted

 1-9     under this subchapter. An employee or department designated under

1-10     this subsection may exercise the municipality's enforcement power,

1-11     including any power to require the vacation, relocation of

1-12     occupants, securing, repair, removal, or demolition of a building

1-13     or other structure.

1-14           (b)  The municipality may designate the employee or

1-15     department to enforce any other municipal ordinance relating to the

1-16     regulation of buildings or other structures and may delegate to the

1-17     employee or department any power the municipality has to enforce

1-18     the ordinance.

1-19           SECTION 2.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended,

1-24     and that this Act take effect and be in force from and after its

 2-1     passage, and it is so enacted.
