A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to vehicle inspection fees.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 548.501, Transportation Code, is amended
1-5 to read as follows:
1-6 Sec. 548.501. Inspection Fees Generally. (a) Except as
1-7 provided by Sections 548.503 and 548.504, the fee for inspection of
1-8 a motor vehicle other than a moped is $10.50. The fee for
1-9 inspection of a moped is $5.75. The fee for a verification form
1-10 issued as required by Section 548.256 is $1.
1-11 (b) An inspection station shall pay to the department $3.50
1-12 [$5.50] of each fee for an inspection. The department may require
1-13 the station to make an advance payment of $3.50 [$5.50] for each
1-14 inspection certificate provided to the station. If advance payment
1-15 is made:
1-16 (1) no further payment may be required on issuance of
1-17 a certificate;
1-18 (2) the inspection station may waive the fee due from
1-19 the owner of an inspected vehicle who is issued a certificate to
1-20 which the advance payment applies;
1-21 (3) the department shall refund to the inspection
1-22 station $3.50 [$5.50] for each unissued certificate that the
1-23 station returns to the department in accordance with department
1-24 rules. [; and]
2-1 [(4) the conservation commission shall pay to the
2-2 department $2 for each unissued certificate that the station
2-3 returns to the department.]
2-4 SECTION 2. Subsection (a), Section 382.0622, Health and
2-5 Safety Code, is amended to read as follows:
2-6 Sec. 382.0622. Clean Air Act Fees. (a) Clean Air Act fees
2-7 consist of[: (1)] fees collected by the commission under Sections
2-8 382.062, 382.0621, and 382.037 and as otherwise provided by law. [;
2-9 and]
2-10 [(2) $2 of each advance payment collected by the
2-11 Department of Public Safety for inspection certificates for
2-12 vehicles other than mopeds under Section 141(c), Uniform Act
2-13 Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil
2-14 Statutes).]
2-15 SECTION 3. EMERGENCY CLAUSE. The importance of this
2-16 legislation and the crowded condition of the calendars in both
2-17 houses create an emergency and an imperative public necessity that
2-18 the constitutional rule requiring bills to be read on three several
2-19 days in each house be suspended, and this rule is hereby suspended,
2-20 and that this Act take effect and be in force from and after its
2-21 passage, and it is so enacted.
