 1-9                                   AN ACT

1-10     relating to the authorization of payroll deductions by employees of

1-11     institutions of higher education for parking fees or parking

1-12     permits.

1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-14           SECTION 1.  Chapter 659, Government Code, is amended by

1-15     adding Subchapter J to read as follows:

1-16        SUBCHAPTER J.  PAYROLL DEDUCTION OF PARKING FEES AND PERMITS

1-17                     AT INSTITUTIONS OF HIGHER EDUCATION

1-18           Sec. 659.201.  DEFINITION.  In this subchapter, "institution

1-19     of higher education"  has the meaning assigned by Section 61.003,

1-20     Education Code.

1-21           Sec. 659.202.  DEDUCTION AUTHORIZED; USE OF FUNDS.  (a)  An

1-22     employee of an institution of higher education may authorize in

1-23     writing a deduction each pay period from the employee's salary or

1-24     wage payment for the payment of parking fees charged by the

1-25     institution of higher education or for the purchase of a parking

1-26     permit from an institution of higher education.  An authorization

1-27     for a deduction under this subchapter by the employee is voluntary.

1-28           (b)  Funds collected under this section may be used only to

1-29     provide parking facilities for employees of the institution.

1-30           Sec. 659.203.  FORM AND MANNER.  A deduction under this

1-31     subchapter must be made in a form and manner prescribed by the

1-32     appropriate financial officer of the institution of higher

1-33     education.

1-34           Sec. 659.204.  CHANGE; DURATION.  (a)  An employee

1-35     authorizing a deduction under this subchapter may change or revoke

1-36     the authorization by delivering written notice of the change or

1-37     revocation to the financial officer of the institution of higher

1-38     education.

1-39           (b)  An authorization under this subchapter is effective

1-40     until the financial officer receives a notice under Subsection (a)

1-41     changing or revoking the authorization.

1-42           (c)  The notice given under Subsection (a) must be in the

1-43     form and manner prescribed by the appropriate financial officer of

1-44     the institution of higher education.

1-45           SECTION 2.  The importance of this legislation and the

1-46     crowded condition of the calendars in both houses create an

1-47     emergency and an imperative public necessity that the

1-48     constitutional rule requiring bills to be read on three several

1-49     days in each house be suspended, and this rule is hereby suspended,

1-50     and that this Act take effect and be in force from and after its

1-51     passage, and it is so enacted.
