                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to required repairs of on-site sewage disposal systems;

 1-3     providing a penalty.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 366.017(a), Health and Safety Code, is

 1-6     amended to read as follows:

 1-7           Sec. 366.017.  Required Repairs; Penalty.  (a)  The

 1-8     commission or authorized agent may require a property owner to

 1-9     repair a malfunctioning on-site sewage disposal system on the

1-10     owner's property not later than the 30th day after the date on

1-11     which the owner is notified by the commission or authorized agent

1-12     of the malfunctioning system.  Upon a second notification within

1-13     the same 12-month period that the system is malfunctioning, the

1-14     commission or authorized agent may require a property owner to

1-15     repair a malfunctioning on-site sewage disposal system on the

1-16     owner's property not later than the 20th day after the date on

1-17     which the owner is notified.  Upon a third violation within the

1-18     same 12-month period, the commission or authorized agent may

1-19     require a property owner to repair a malfunctioning on-site sewage

1-20     disposal system on the owner's property not later than the 10th day

1-21     after the date on which the owner is notified.

1-22           SECTION 2.  The importance of this legislation and the

1-23     crowded condition of the calendars in both houses create an

1-24     emergency and an imperative public necessity that the

 2-1     constitutional rule requiring bills to be read on three several

 2-2     days in each house be suspended, and this rule is hereby suspended,

 2-3     and that this Act take effect and be in force from and after its

 2-4     passage, and it is so enacted.
