                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the disposal of a dead animal found on a municipal

 1-3     street or county road.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Chapter 821, Health and Safety Code, is amended

 1-6     by adding Subchapter C to read as follows:

 1-7              SUBCHAPTER C.  DISPOSAL OF DEAD ANIMALS FOUND ON

 1-8                               STREET OR ROAD

 1-9           Sec. 821.041.  DISPOSAL.  A municipality or county may

1-10     dispose of the carcass of an animal killed on a municipal street or

1-11     county road by burying the carcass on property owned by the entity

1-12     responsible for maintenance of the municipal street or county road.

1-13           Sec. 821.042.  DISPOSITION AND PUBLIC HEALTH.  Disposal of

1-14     the carcass shall be conducted in a manner consistent with public

1-15     health.

1-16           Sec. 821.043.  OTHER STATUTE OR PERMIT REQUIREMENT NOT

1-17     APPLICABLE.  Chapter 361 or a permit required under that chapter

1-18     does not apply to the disposition of an animal under this section.

1-19           SECTION 2.  This Act takes effect September 1, 1997.

1-20           SECTION 3.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended.
