1-1                                   AN ACT

 1-2     relating to the payment of funds to support the Early High School

 1-3     Graduation Scholarship Program.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 56.207, Education Code, is amended to

 1-6     read as follows:

 1-7           Sec. 56.207.  PAYMENT OF TUITION CREDIT.  (a)  [On receipt of

 1-8     a report from an eligible institution of higher education under

 1-9     Section 56.206(c), the coordinating board shall distribute to the

1-10     institution the amount of the state tuition credit applied by the

1-11     institution.]

1-12           [(b)]  At least once each year the coordinating board shall

1-13     submit a report to the commissioner of education that includes:

1-14                 (1)  the name of each student who used state tuition

1-15     credit under this subchapter during the period covered by the

1-16     report;

1-17                 (2)  the school district from which each student

1-18     graduated from high school; and

1-19                 (3)  the amount of the state tuition credit used by

1-20     each student during the period covered by the report.

1-21           (b) [(c)]  On receipt of a report from the coordinating board

1-22     under Subsection (a) [(b)], the commissioner shall transfer to the

1-23     coordinating board, from funds appropriated for the Foundation

1-24     School Program, an amount sufficient to pay each eligible

 2-1     institution of higher education the amount of state tuition credit

 2-2     applied by the institution [reimburse the coordinating board for

 2-3     amounts disbursed in payment of state tuition credits] during the

 2-4     period covered by the report.

 2-5           (c)  The coordinating board shall distribute the appropriate

 2-6     amount of funds to each eligible institution when the board

 2-7     receives the funds under Subsection (b).

 2-8           SECTION 2.  This Act takes effect September 1, 1997.

 2-9           SECTION 3.  The importance of this legislation and the

2-10     crowded condition of the calendars in both houses create an

2-11     emergency and an imperative public necessity that the

2-12     constitutional rule requiring bills to be read on three several

2-13     days in each house be suspended, and this rule is hereby suspended.
