A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the regulation of the use of bingo card-minding
1-3 devices.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 11(v), Bingo Enabling Act (Article 179d,
1-6 Vernon's Texas Civil Statutes), is amended to read as follows:
1-7 (v) A person may not use a card-minding device:
1-8 (1) to generate or determine the random letters,
1-9 numbers, or other symbols used in playing the bingo card played
1-10 with the device's assistance;
1-11 (2) as a receptacle for the deposit of tokens or
1-12 money, including coins or paper currency, in payment for playing
1-13 the bingo card played with the device's assistance; or
1-14 (3) except as provided by Section 13e(i) of this Act,
1-15 as a dispenser for the payment of a bingo prize, including coins,
1-16 paper currency, or any thing of value for the bingo card played
1-17 with the device's assistance. No more than 40 [30] percent of the
1-18 individuals attending a [gross bingo game sales at each] bingo
1-19 occasion, based on the average of the two quarterly attendance
1-20 reports that have been most recently submitted to the commission by
1-21 the authorized organization, may use [can be on] electronic or
1-22 mechanical card-minding devices. This provision does not
1-23 include[,] pull-tabs, instant bingo tickets, or break-open bingo
1-24 games.
2-1 SECTION 2. Section 13e, Bingo Enabling Act (Article 179d,
2-2 Vernon's Texas Civil Statutes), is amended by adding Subsections
2-3 (i)-(l) to read as follows:
2-4 (i) Section 11(v)(3) of this Act does not apply to a system
2-5 service provider.
2-6 (j) A system service provider may use bar codes on bingo
2-7 paper as a means of providing accurate accounting records.
2-8 (k) A system service provider shall purchase goods or
2-9 services from a licensed manufacturer.
2-10 (l) The commission shall include a system service provider
2-11 as a member of a bingo advisory committee appointed under Section
2-12 43 of this Act.
2-13 SECTION 3. This Act takes effect October 1, 1997.
2-14 SECTION 4. The importance of this legislation and the
2-15 crowded condition of the calendars in both houses create an
2-16 emergency and an imperative public necessity that the
2-17 constitutional rule requiring bills to be read on three several
2-18 days in each house be suspended, and this rule is hereby suspended.
