No. 3386 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the purposes and powers of an electric cooperative 1-3 corporation serving a border county. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. The Electric Cooperative Corporation Act (Article 1-6 1528b, Vernon's Texas Civil Statutes) is amended by adding Section 1-7 4B to read as follows: 1-8 Sec. 4B. ADDITIONAL PURPOSES AND POWERS OF CORPORATION 1-9 SERVING BORDER COUNTIES. (a) This section applies only to a 1-10 corporation that serves retail customers in a county that is 1-11 contiguous to an international border. 1-12 (b) In addition to the purposes and powers otherwise 1-13 provided by this Act, a corporation to which this section applies 1-14 and that complies with all requirements of a public utility under 1-15 Chapter 13, Water Code, may provide, directly or through an 1-16 affiliate, the following activities within any portion of the 1-17 corporation's service area: 1-18 (1) rural community utility and utility-related 1-19 services, including water and sewer services, Internet services, 1-20 and telephone answering services, but not including 1-21 telecommunications services governed by the Public Utility 1-22 Regulatory Act of 1995 (Article 1446c-0, Vernon's Texas Civil 1-23 Statutes) or electricity; 1-24 (2) management or operating services to or for another 2-1 corporation or another entity engaged in purposes authorized by 2-2 Section 3 of this Act; and 2-3 (3) economic and industrial development promotion 2-4 through participation as a borrower or lender under a federal 2-5 program. 2-6 (c) The corporation has all powers, including the power to 2-7 borrow money, necessary or appurtenant to the purposes and powers 2-8 provided by Subsection (b) of this section. 2-9 SECTION 2. The importance of this legislation and the 2-10 crowded condition of the calendars in both houses create an 2-11 emergency and an imperative public necessity that the 2-12 constitutional rule requiring bills to be read on three several 2-13 days in each house be suspended, and this rule is hereby suspended, 2-14 and that this Act take effect and be in force from and after its 2-15 passage, and it is so enacted.
