                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the boundaries of a county development district.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter D, Chapter 312, Tax Code, is amended

 1-5     by adding Section 312.6051 to read as follows:

 1-6           Sec. 312.6051.  RESTRICTION ON BOUNDARIES OF DISTRICT.

 1-7     (a)  A county development district created after August 31, 1997,

 1-8     may not include territory located in a municipality.

 1-9           (b)  After August 31, 1997, a county development district may

1-10     not add territory to the district if the territory is located in a

1-11     municipality.

1-12           SECTION 2.  This Act takes effect September 1, 1997, and

1-13     applies only to a county development district that is created or

1-14     expanded on or after that date.  A county development district that

1-15     was created or expanded before the effective date of this Act is

1-16     governed by the law in effect on the date on which the district was

1-17     created, and the former law is continued in effect for that

1-18     purpose.

1-19           SECTION 3.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended.
