1-1                                   AN ACT

 1-2     relating to the authorization of a closed meeting by the

 1-3     commissioners court of a county to deliberate certain personnel

 1-4     actions affecting a member of an advisory body.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Subchapter D, Chapter 551, Government Code, is

 1-7     amended by adding Section 551.0745 to read as follows:

 1-8           Sec. 551.0745.  PERSONNEL MATTERS AFFECTING COUNTY ADVISORY

 1-9     BODY; CLOSED MEETING.  (a)  This chapter does not require the

1-10     commissioners court of a county to conduct an open meeting:

1-11                 (1)  to deliberate the appointment, employment,

1-12     evaluation, reassignment, duties, discipline, or dismissal of a

1-13     member of an advisory body; or

1-14                 (2)  to hear a complaint or charge against a member of

1-15     an advisory body.

1-16           (b)  Subsection (a) does not apply if the individual who is

1-17     the subject of the deliberation or hearing requests a public

1-18     hearing.

1-19           SECTION 2.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended,

1-24     and that this Act take effect and be in force from and after its

 2-1     passage, and it is so enacted.
