No. 3448 1-2 (In the Senate - Received from the House May 8, 1997; 1-3 May 9, 1997, read first time and referred to Committee on State 1-4 Affairs; May 16, 1997, reported favorably by the following vote: 1-5 Yeas 13, Nays 0; May 16, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the authorization of a closed meeting by the 1-9 commissioners court of a county to deliberate certain personnel 1-10 actions affecting a member of an advisory body. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subchapter D, Chapter 551, Government Code, is 1-13 amended by adding Section 551.0745 to read as follows: 1-14 Sec. 551.0745. PERSONNEL MATTERS AFFECTING COUNTY ADVISORY 1-15 BODY; CLOSED MEETING. (a) This chapter does not require the 1-16 commissioners court of a county to conduct an open meeting: 1-17 (1) to deliberate the appointment, employment, 1-18 evaluation, reassignment, duties, discipline, or dismissal of a 1-19 member of an advisory body; or 1-20 (2) to hear a complaint or charge against a member of 1-21 an advisory body. 1-22 (b) Subsection (a) does not apply if the individual who is 1-23 the subject of the deliberation or hearing requests a public 1-24 hearing. 1-25 SECTION 2. The importance of this legislation and the 1-26 crowded condition of the calendars in both houses create an 1-27 emergency and an imperative public necessity that the 1-28 constitutional rule requiring bills to be read on three several 1-29 days in each house be suspended, and this rule is hereby suspended, 1-30 and that this Act take effect and be in force from and after its 1-31 passage, and it is so enacted. 1-32 * * * * *
