                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to coupons for certain speeding offenses.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  The purpose of this Act is to promote energy

 1-5     conservation.

 1-6           SECTION 2.  Subchapter H, Chapter 545, Transportation Code,

 1-7     is amended by adding Section 545.366 to read as follows:

 1-8           Sec. 545.366.  SPEED COUPONS.  (a)  On presentation of a

 1-9     coupon provided for by this section by a person stopped by a law

1-10     enforcement officer for an offense of driving at a speed greater

1-11     than the applicable prima facie speed limit but less than 10 miles

1-12     per hour more than that limit, the law enforcement officer shall

1-13     immediately release the person and may not issue the person a

1-14     notice to appear for the offense.

1-15           (b)  The Texas Lottery Commission shall provide for sale of

1-16     the coupons by lottery sales agents licensed under Chapter 466,

1-17     Government Code.  The commission shall:

1-18                 (1)  set the price of each coupon at an appropriate

1-19     amount not less than $15 or more than $100; and

1-20                 (2)  determine an appropriate period of validity after

1-21     which a coupon expires.

1-22           (c)  There is not a limit on the number of coupons a person

1-23     may purchase.

1-24           (d)  Money collected from purchase of the coupons shall be

 2-1     deposited in the state treasury, with 40 percent to the credit of

 2-2     the Judicial Fund, with 20 percent to the credit of the Teachers

 2-3     Retirement Fund, and the remainder to the credit of the general

 2-4     revenue fund.

 2-5           (e)  The Texas Lottery Commission may adopt rules to

 2-6     administer this section.

 2-7           SECTION 3.  The importance of this legislation and the

 2-8     crowded condition of the calendars in both houses create an

 2-9     emergency and an imperative public necessity that the

2-10     constitutional rule requiring bills to be read on three several

2-11     days in each house be suspended, and this rule is hereby suspended,

2-12     and that this Act take effect and be in force from and after its

2-13     passage, and it is so enacted.
