                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to salary and benefits payable to certain persons formerly

 1-3     employed by school districts.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 21.304(f), Education Code, is amended to

 1-6     read as follows:

 1-7           (f)  Instead of reinstating a teacher under Subsection (e),

 1-8     the school district may pay the teacher [one year's] salary and

 1-9     benefits as agreed through negotiation between the district and the

1-10     teacher [to which the teacher would have been entitled from the

1-11     date on which the teacher would have been reinstated].

1-12           SECTION 2.  Section 21.304(f), Education Code, as amended by

1-13     this Act, applies to a school district employee to whom that

1-14     section applies who has not received a payment under that section

1-15     before the effective date of this Act even if the commissioner of

1-16     education's order to reinstate the employee is issued before the

1-17     effective date of this Act.

1-18           SECTION 3.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

1-22     days in each house be suspended, and this rule is hereby suspended,

1-23     and that this Act take effect and be in force from and after its

1-24     passage, and it is so enacted.
