                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the board of directors of the Sandy Land Underground

 1-3     Water Conservation District.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 7, Chapter 673, Acts of the 71st

 1-6     Legislature, Regular Session, 1989, is amended to read as follows:

 1-7           Sec. 7.  Board of Directors.  (a)  The district is governed

 1-8     by a board of five directors who serve staggered four-year terms.

 1-9           (b)  The directors of the district shall be elected according

1-10     to the commissioners precinct method as provided by this section

1-11     [Temporary directors serve until initial permanent directors are

1-12     elected under Section 9 of this Act].

1-13           (c)  One director shall be elected by the electors of the

1-14     entire district, and one director shall be elected from each county

1-15     commissioners precinct by the electors of that precinct [Initial

1-16     permanent directors serve until permanent directors are elected

1-17     under Section 10 of this Act].

1-18           (d)  A person shall indicate on the application for a place

1-19     on the ballot the precinct that the person seeks to represent or

1-20     that the person seeks to represent the district at large [Permanent

1-21     directors other than initial permanent directors serve staggered

1-22     four-year terms].

1-23           (e)  At the first election after the county commissioners

1-24     precincts are redrawn under Section 18, Article V, Texas

 2-1     Constitution, four new directors shall be elected to represent the

 2-2     precincts.  The directors elected shall draw lots to determine

 2-3     their terms.

 2-4           (f)  Each director must qualify to serve as director in the

 2-5     manner provided by Section 49.055 [Sections 51.078 and 51.079],

 2-6     Water Code.

 2-7           (g) [(f)]  A director serves until the director's successor

 2-8     has qualified.

 2-9           SECTION 2.  On the first Saturday in May 1998, an election

2-10     shall be held to elect all five directors of the Sandy Land

2-11     Underground Water Conservation District.  The directors elected

2-12     shall draw lots to determine which two directors serve two-year

2-13     terms and which three serve four-year terms.  Directors elected in

2-14     subsequent elections serve terms as provided by Section 7, Chapter

2-15     673, Acts of the 71st Legislature, Regular Session, 1989, as

2-16     amended by this Act.  The terms of the directors serving on the

2-17     effective date of this Act expire when the directors elected under

2-18     this section qualify for office.

2-19           SECTION 3.  The importance of this legislation and the

2-20     crowded condition of the calendars in both houses create an

2-21     emergency and an imperative public necessity that the

2-22     constitutional rule requiring bills to be read on three several

2-23     days in each house be suspended, and this rule is hereby suspended,

2-24     and that this Act take effect and be in force from and after its

2-25     passage, and it is so enacted.
