1-2 relating to the boundaries, confirmation election, and taxing
1-3 authority of the Clear Creek Watershed Regional Flood Control
1-4 District.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 3, Chapter 699, Acts of the 74th
1-7 Legislature, Regular Session, 1995, is amended to read as follows:
1-8 SECTION 3. BOUNDARIES OF DISTRICT. The district is composed
1-9 of land in Harris County, Galveston County, Brazoria County, and
1-10 Fort Bend County. The boundaries of the district can be described
1-11 as follows:
1-12 Being approximately 186.4-square miles of land in Harris County,
1-13 Galveston County, Brazoria County and Fort Bend County, Texas; and

15-20 part of Harris County tract 0373.11 included in blocks 101A, 101B,
15-21 102, 103, 104, 301A, 301B, 302, 303A, and 303B; and that part of
15-22 Harris County tract 0373.21 included in block groups 2 and 3 and
15-23 blocks 111, and 112].
15-24 SECTION 2. Section 5(a), Chapter 699, Acts of the 74th
15-25 Legislature, Regular Session, 1995, is amended to read as follows:
15-26 (a) The district may not exercise a power granted by this
15-27 Act other than a power granted by this section until the creation
16-1 of the district is confirmed by a majority of the resident electors
16-2 of the district voting at a confirmation election called under this
16-3 section. The initial board shall call a confirmation election to
16-4 be held not later than three [two] years after the effective date
16-5 of this Act within the boundaries of the proposed district. The
16-6 board may call subsequent confirmation elections if the district is
16-7 not confirmed at the first election. Expenses of a confirmation
16-8 election shall be paid in equal shares by each of the commissioners
16-9 courts and shall be repaid by the district if creation of the
16-10 district is confirmed. Section 41.001(a), Election Code, does not
16-11 apply to a confirmation election.
16-12 SECTION 3. Sections 37(a) and (b), Chapter 699, Acts of the
16-13 74th Legislature, Regular Session, 1995, are amended to read as
16-14 follows:
16-15 (a) An ad valorem maintenance tax under Subsection (b) must
16-16 be authorized by a majority vote of the voters qualified to vote
16-17 and voting in the district at an election called and held for that
16-18 purpose.
16-19 (b) If approved by the voters, the [The] district may levy,
16-20 assess, and collect an annual ad valorem tax on all taxable
16-21 property in the district for the maintenance, operation, upkeep,
16-22 and improvement of the district and its facilities, properties, and
16-23 improvements.
16-24 [(b) An ad valorem maintenance tax under Subsection (a) must
16-25 be authorized by a majority vote of the voters qualified to vote
16-26 and voting in the district at an election called and held for that
16-27 purpose.]
17-1 SECTION 4. The importance of this legislation and the
17-2 crowded condition of the calendars in both houses create an
17-3 emergency and an imperative public necessity that the
17-4 constitutional rule requiring bills to be read on three several
17-5 days in each house be suspended, and this rule is hereby suspended,
17-6 and that this Act take effect and be in force from and after its
17-7 passage, and it is so enacted.
