No. 3585 1-2 (In the Senate - Received from the House May 8, 1997; 1-3 May 9, 1997, read first time and referred to Committee on State 1-4 Affairs; May 16, 1997, reported favorably by the following vote: 1-5 Yeas 13, Nays 0; May 16, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to authorizing the General Services Commission to convey 1-9 certain state-owned property to the City of Austin. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. (a) The General Services Commission may convey, 1-12 on behalf of the state, the state's interest in the real property 1-13 described by Subsection (e) of this section to the City of Austin. 1-14 (b) The purchase and sale agreement relating to the 1-15 conveyance authorized by this section: 1-16 (1) shall require the City of Austin to pay cash 1-17 consideration in an amount that is equal to at least the fair 1-18 market value of the real property as determined by an appraisal 1-19 performed by the General Land Office; and 1-20 (2) may require other terms and conditions negotiated 1-21 by the General Services Commission and the City of Austin. 1-22 (c) The General Services Commission may transfer the real 1-23 property only by a special warranty deed. 1-24 (d) Section 31.158, Natural Resources Code, does not apply 1-25 to the conveyance authorized by this section. 1-26 (e) The real property is described alternatively as: 1-27 (1) a 20.206 acre parcel described as Lots 1-2, Block 1-28 A, Lots 1-11, Block B, Lots 1-3, Block C, Wilbarger Place, Section 1-29 One, City of Austin, Travis County, Texas; and 1-30 (2) 20.206 acres situated in the Henry Warnell Survey, 1-31 Abstract Number 793, and in the Joseph Burleson Survey, Abstract 1-32 Number 62, in the City of Austin, Travis County, Texas. 1-33 SECTION 2. The proceeds from the conveyance shall be 1-34 deposited in the state treasury and may be used only by the General 1-35 Services Commission for relocating operations of the State Aircraft 1-36 Pooling Board from the Robert Mueller Municipal Airport to the 1-37 airport located in Travis County, Texas, known, on the effective 1-38 date of this Act, as the Austin Bergstrom International Airport. 1-39 SECTION 3. The importance of this legislation and the 1-40 crowded condition of the calendars in both houses create an 1-41 emergency and an imperative public necessity that the 1-42 constitutional rule requiring bills to be read on three several 1-43 days in each house be suspended, and this rule is hereby suspended, 1-44 and that this Act take effect and be in force from and after its 1-45 passage, and it is so enacted. 1-46 * * * * *
