No. 3594 1-2 (In the Senate - Received from the House May 12, 1997; 1-3 May 13, 1997, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 16, 1997, reported favorably by 1-5 the following vote: Yeas 11, Nays 0; May 16, 1997, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to granting additional powers to the Westchase District, 1-10 formerly known as the Westchase Area Management District. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Section 13, Chapter 491, Acts of the 74th 1-13 Legislature, Regular Session, 1995, is amended by adding Subsection 1-14 (h) to read as follows: 1-15 (h) The district may, without additional procedures, grant 1-16 abatements for taxes or assessments owed to the district under 1-17 Chapter 312, Tax Code. 1-18 SECTION 2. (a) The legislature validates and confirms all 1-19 governmental acts and proceedings of the Westchase District and the 1-20 district's board of directors that occurred before the effective 1-21 date of this Act. 1-22 (b) This section does not apply to any matter that on the 1-23 effective date of this Act: 1-24 (1) is involved in litigation if the litigation 1-25 ultimately results in the matter being held invalid by a final 1-26 judgment of a court of competent jurisdiction; or 1-27 (2) has been held invalid by a court of competent 1-28 jurisdiction. 1-29 SECTION 3. The importance of this legislation and the 1-30 crowded condition of the calendars in both houses create an 1-31 emergency and an imperative public necessity that the 1-32 constitutional rule requiring bills to be read on three several 1-33 days in each house be suspended, and this rule is hereby suspended, 1-34 and that this Act take effect and be in force from and after its 1-35 passage, and it is so enacted. 1-36 * * * * *
