1-1 AN ACT
1-2 relating to validating certain acts of the Garza County Underground
1-3 and Fresh Water Conservation District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. VALIDATION. (a) The following actions of the
1-6 Garza County Underground and Fresh Water Conservation District and
1-7 the district's temporary or initial board of directors are
1-8 validated and confirmed as if the actions had been done as
1-9 authorized by law:
1-10 (1) the election confirming the creation of the
1-11 district and electing initial directors;
1-12 (2) any action of the district's temporary board of
1-13 directors taken to call or conduct the election to confirm the
1-14 creation of the district and elect initial directors; and
1-15 (3) any action of the district's initial board of
1-16 directors taken before the effective date of this Act.
1-17 (b) Each initial director of the Garza County Underground
1-18 and Fresh Water Conservation District, elected in conjunction with
1-19 the district's confirmation election, is confirmed and validated as
1-20 a district director and may serve the term to which the director
1-21 was elected.
1-22 SECTION 2. FINDINGS RELATED TO BOUNDARIES. The legislature
1-23 finds that the boundaries of the Garza County Underground and Fresh
1-24 Water Conservation District include the city of Post, Texas,
2-1 despite any irregularity in calling or holding the election to
2-2 confirm the district or elect initial directors as provided by
2-3 Section 10, Chapter 188, Acts of the 74th Legislature, Regular
2-4 Session, 1995.
2-5 SECTION 3. ELECTIONS. After the effective date of this Act,
2-6 the board of directors of the Garza County Underground and Fresh
2-7 Water Conservation District shall call and hold elections to elect
2-8 district directors in accordance with Sections 6, 7, and 11,
2-9 Chapter 188, Acts of the 74th Legislature, Regular Session, 1995.
2-10 SECTION 4. APPLICABILITY. This Act does not apply to any
2-11 matter that is the subject of litigation on the effective date of
2-12 this Act.
2-13 SECTION 5. EMERGENCY. The importance of this legislation
2-14 and the crowded condition of the calendars in both houses create an
2-15 emergency and an imperative public necessity that the
2-16 constitutional rule requiring bills to be read on three several
2-17 days in each house be suspended, and this rule is hereby suspended,
2-18 and that this Act take effect and be in force from and after its
2-19 passage, and it is so enacted.
