No. 3607 1-2 (In the Senate - Received from the House May 12, 1997; 1-3 May 13, 1997, read first time and referred to Committee on Natural 1-4 Resources; May 17, 1997, reported favorably by the following vote: 1-5 Yeas 10, Nays 0; May 17, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to validating certain acts of the Garza County Underground 1-9 and Fresh Water Conservation District. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. VALIDATION. (a) The following actions of the 1-12 Garza County Underground and Fresh Water Conservation District and 1-13 the district's temporary or initial board of directors are 1-14 validated and confirmed as if the actions had been done as 1-15 authorized by law: 1-16 (1) the election confirming the creation of the 1-17 district and electing initial directors; 1-18 (2) any action of the district's temporary board of 1-19 directors taken to call or conduct the election to confirm the 1-20 creation of the district and elect initial directors; and 1-21 (3) any action of the district's initial board of 1-22 directors taken before the effective date of this Act. 1-23 (b) Each initial director of the Garza County Underground 1-24 and Fresh Water Conservation District, elected in conjunction with 1-25 the district's confirmation election, is confirmed and validated as 1-26 a district director and may serve the term to which the director 1-27 was elected. 1-28 SECTION 2. FINDINGS RELATED TO BOUNDARIES. The legislature 1-29 finds that the boundaries of the Garza County Underground and Fresh 1-30 Water Conservation District include the city of Post, Texas, 1-31 despite any irregularity in calling or holding the election to 1-32 confirm the district or elect initial directors as provided by 1-33 Section 10, Chapter 188, Acts of the 74th Legislature, Regular 1-34 Session, 1995. 1-35 SECTION 3. ELECTIONS. After the effective date of this Act, 1-36 the board of directors of the Garza County Underground and Fresh 1-37 Water Conservation District shall call and hold elections to elect 1-38 district directors in accordance with Sections 6, 7, and 11, 1-39 Chapter 188, Acts of the 74th Legislature, Regular Session, 1995. 1-40 SECTION 4. APPLICABILITY. This Act does not apply to any 1-41 matter that is the subject of litigation on the effective date of 1-42 this Act. 1-43 SECTION 5. EMERGENCY. The importance of this legislation 1-44 and the crowded condition of the calendars in both houses create an 1-45 emergency and an imperative public necessity that the 1-46 constitutional rule requiring bills to be read on three several 1-47 days in each house be suspended, and this rule is hereby suspended, 1-48 and that this Act take effect and be in force from and after its 1-49 passage, and it is so enacted. 1-50 * * * * *
