                             HOUSE CONCURRENT RESOLUTION

 1-1           WHEREAS, Betty Warner alleges that:

 1-2                 (1)  on May 11, 1994, the Texas Department of Human

 1-3     Services entered into a settlement agreement with Betty  Warner

 1-4     regarding her employment;

 1-5                 (2)  the Texas Department of Human Services has failed

 1-6     to fulfill the settlement agreement; and

 1-7                 (3)  Betty Warner is entitled to enforce the agreed

 1-8     settlement and to back pay and lost benefits from the date of her

 1-9     termination to the present; now, therefore, be it

1-10           RESOLVED by the Legislature of the State of Texas, That Betty

1-11     Warner is granted permission to sue the State of Texas and the

1-12     Texas Department of Human Services subject to Chapter 107, Civil

1-13     Practice and Remedies Code; and, be it further

1-14           RESOLVED, That the commissioner of human services of the

1-15     Texas Department of Human Services be served process as provided by

1-16     Section 107.002(a)(3), Civil Practice and Remedies Code.
