                             HOUSE CONCURRENT RESOLUTION

 1-1           WHEREAS, House Bill No. 3490 has been adopted by the house of

 1-2     representatives and the senate; and

 1-3           WHEREAS,  The bill contains a technical error that should be

 1-4     corrected; now, therefore, be it

 1-5           RESOLVED, That the enrolling clerk of the house of

 1-6     representatives be hereby instructed to correct House Bill No. 3490

 1-7     by striking SECTION 3 of the bill, as added by Senate Committee

 1-8     Amendment No. 1, and substituting the following:

 1-9           SECTION 3.  Section 93.042, Natural Resources Code, is

1-10     amended to read as follows:

1-11           Sec. 93.042.  PREVENTION OF POLLUTION.  This chapter does not

1-12     limit the commission's authority under this title to prevent

1-13     pollution, plug wells, or control or clean up oil and gas wastes or

1-14     other substances or material.  The commission, while a well is in

1-15     the TERRA program, shall assume all well plugging duties for the

1-16     well and, with the exception of the compliance requirements of a

1-17     valid TERRA license holder, all pollution prevention and control

1-18     responsibilities.  The commission shall conduct annual inspections

1-19     and appropriate tests to ensure the continuing integrity of the

1-20     wellbore.  The commission shall keep and retain the necessary

1-21     records to prove compliance with this requirement.
