                             HOUSE CONCURRENT RESOLUTION

 1-1           WHEREAS, Jose Angel Gutierrez alleges that:

 1-2                 (1)  on October 29, 1996, The University of Texas

 1-3     System and The University of Texas at Arlington entered into a

 1-4     settlement agreement with Jose Angel Gutierrez regarding his

 1-5     employment;

 1-6                 (2)  The University of Texas System and The University

 1-7     of Texas at Arlington have failed to fulfill the settlement

 1-8     agreement; and

 1-9                 (3)  he may be entitled to the enforcement of the

1-10     settlement agreement, reinstatement to his position and title, back

1-11     pay, and any lost benefits and damages from the date of his

1-12     termination to the present; now, therefore, be it

1-13           RESOLVED by the Legislature of the State of Texas, That Jose

1-14     Angel Gutierrez is granted permission to sue the State of Texas,

1-15     The University of Texas System, and The University of Texas at

1-16     Arlington subject to Chapter 107, Civil Practice and Remedies Code;

1-17     and, be it further

1-18           RESOLVED, That the chancellor of The University of Texas

1-19     System and the president of The University of Texas at Arlington be

1-20     served process as provided by Section 107.002(a)(3), Civil Practice

1-21     and Remedies Code.
