                             HOUSE CONCURRENT RESOLUTION

 1-1           WHEREAS, House Bill No. 337 has been adopted by the house of

 1-2     representatives and the senate and is being prepared for

 1-3     enrollment; and

 1-4           WHEREAS, The bill contains technical errors that should be

 1-5     corrected; now, therefore, be it

 1-6           RESOLVED by the 75th Legislature of the State of Texas, That

 1-7     the enrolling clerk of the house of representatives be instructed

 1-8     to correct House Bill No. 337 as follows:

 1-9           Strike Section 2(b), Texas Statewide Volunteer Fire Fighters

1-10     Retirement Act (Article 6243e.3, Vernon's Texas Civil Statutes), as

1-11     amended by the senate committee substitute, and substitute the

1-12     following:

1-13           (b)  Participation in the fund is optional.  A [Any]

1-14     governing body may, [not later than 60 days after the effective

1-15     date of this Act and] in accordance with the usual procedures

1-16     prescribed for taking [other] official action [actions] of the

1-17     governing body, elect to participate in [exempt itself from] the

1-18     requirements of this Act.  Any action to not participate in

1-19     [provide for an exemption from] the requirements of this Act may be

1-20     rescinded by the governing body at any time.  A municipality that

1-21     has elected to participate in this fund may not rescind that

1-22     election.
